Thank you for using AI ASK Chat GPT by MK APPS PVT LTD ("we," "us," "our," or "Company").
These Terms and Conditions ("Terms") govern your use of the AI ASK Chat GPT iOS application ("App"). By accessing or using the App, you agree to these Terms.
Please read these Terms and our Privacy Policy carefully before using the App.
1. Acceptance of Terms
By accessing or using AI ASK Chat GPT, you acknowledge that you have read, understood, and agree to be bound by these Terms.
If you do not agree with these Terms, you should not use the App.
Your use of specific features may also be subject to additional terms, notices, or permissions presented within the App.
2. Description of the App
AI ASK Chat GPT provides AI-powered and productivity features that may include:
- AI Chat
- AI Assistance
- AI Photo Generation
- Object Remover
- Image Analysis
- Math Export
- AI Voice
- PDF Summary
- Text Recognition
- Document and image processing
- Other AI-powered tools and features that may be added in the future
Features may change, be updated, or be discontinued from time to time.
3. AI Features and Third-Party AI Providers
Some features of the App use third-party AI or processing services.
Depending on the feature or AI model selected, these services may include:
- OpenAI
- Google Gemini
- Anthropic Claude
- DeepSeek
- Sonar
- Other third-party AI or processing providers that may be used to provide specific features
Different features may use different AI providers.
The applicable provider may depend on the AI model or feature selected by you.
4. AI Data Sharing and User Consent
Some AI features require content provided by you to be sent to a third-party AI provider.
Depending on the feature, this content may include:
- Text prompts
- Chat messages and conversations
- Images and photos
- Documents and PDF files
- Mathematical content
- Audio or voice content
- Text recognized from images
- Other content that you voluntarily submit
Before applicable content is sent to a third-party AI provider, the App may display an AI Data Sharing Notice explaining what information will be shared, the applicable AI provider, and the purpose of processing.
Where consent is required, you will be asked to provide permission before the applicable content is transmitted.
By selecting "Agree & Continue," you authorize the applicable content to be sent to the selected AI provider for the purpose of providing the requested feature.
If you select "Decline," you may continue to use and explore other parts of the App. However, features that require third-party AI processing may not work until the required permission is provided.
If you later attempt to use a feature that requires third-party AI processing, the App may display the AI Data Sharing Notice again.
Our Privacy Policy provides additional information about AI data processing and third-party providers.
5. User Responsibilities
You are responsible for the content you choose to submit, process, generate, or otherwise use through the App.
You agree that you will:
- Use the App only for lawful purposes
- Comply with applicable laws and regulations
- Respect the rights and privacy of others
- Only submit content that you have the right or permission to use
- Avoid submitting passwords, payment information, confidential information, or other sensitive information that you do not want to share with an applicable AI provider
- Review AI-generated results before relying on them
- Use the App responsibly and in accordance with these Terms
6. Prohibited Uses
You must not use the App to:
- Violate any applicable law or regulation
- Commit or facilitate fraud or other illegal activities
- Generate, request, distribute, or promote unlawful content
- Generate or distribute sexually explicit or NSFW content
- Promote violence, abuse, terrorism, or dangerous activities
- Encourage self-harm or harm to others
- Harass, threaten, or abuse other people
- Infringe copyrights, trademarks, privacy rights, or other intellectual property rights
- Create deceptive or fraudulent content intended to cause harm
- Attempt to bypass safety filters or technical restrictions
- Abuse, disrupt, or interfere with the operation of the App or its services
- Reverse engineer, exploit, or attempt to gain unauthorized access to the App or its underlying services
- Use the App in a way that violates the terms or policies of applicable third-party AI providers
We may restrict or terminate access to the App or applicable features if we reasonably believe that a user has violated these Terms or applicable laws.
7. AI-Generated Content
AI-generated content is produced using automated systems and may contain errors, inaccuracies, omissions, or unexpected results.
We do not guarantee that AI-generated content will be:
- Accurate
- Complete
- Reliable
- Suitable for a particular purpose
- Current
- Free from errors
You are responsible for reviewing AI-generated content before using, publishing, sharing, or relying on it.
AI-generated content should not be treated as professional advice.
8. No Professional Advice
The App provides general informational and AI-generated assistance.
The App is not a substitute for professional medical, legal, financial, educational, mental health, or other professional advice.
You should consult an appropriately qualified professional when professional advice is required.
Never rely solely on AI-generated information when making decisions that could affect your health, safety, finances, legal rights, or other important matters.
9. User Content
You retain responsibility for content that you submit to or create through the App.
You represent that you have the necessary rights, permissions, and authority to submit any content that you provide through the App.
You must not submit content that violates another person's privacy, intellectual property rights, or other legal rights.
By using a feature that processes your content, you authorize the App and applicable service providers to process that content as necessary to provide the requested functionality, subject to the consent and privacy disclosures provided within the App and our Privacy Policy.
10. Local Storage and Data
The App does not require users to create an account or log in to use its core features.
Certain content, such as saved images, chat history, conversations, and other application data, may be stored locally on your device.
If you delete the App from your device, locally stored application data may also be deleted.
Content submitted to third-party AI providers may be transmitted and processed by those providers to complete your requested feature. Their processing and retention practices are governed by their applicable terms and privacy policies.

11. Third-Party Services
The App may rely on third-party services to provide AI processing, analytics, diagnostics, payments, infrastructure, and other functionality.

Your use of features that rely on third-party services may also be subject to the applicable provider's terms, policies, and restrictions.
We are not responsible for the independent policies, availability, content, or practices of third-party services.
12. Intellectual Property
AI ASK Chat GPT, including its software, design, interface, logos, graphics, trademarks, and other original materials, is owned by or licensed to MK APPS PVT LTD and is protected by applicable intellectual property laws.
Except as expressly permitted by these Terms or applicable law, you may not:
- Copy or reproduce the App
- Modify or create derivative works
- Reverse engineer or decompile the App
- Redistribute or resell the App
- Remove proprietary notices
- Use our trademarks or branding without permission
13. License to Use the App
Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the App for its intended purposes.
This license does not transfer ownership of the App or any intellectual property rights to you.
14. Availability and Changes
We may update, modify, suspend, or discontinue the App or any feature at any time.
AI models, third-party providers, available features, processing methods, and functionality may change without prior notice.
We do not guarantee that any particular AI model, provider, feature, or functionality will always remain available.
15. Disclaimer of Warranties
The App and its features are provided on an "as is" and "as available" basis to the maximum extent permitted by applicable law.
We do not guarantee that:
- The App will always be available
- The App will be error-free
- AI-generated results will always be accurate
- AI-generated results will meet your expectations
- Third-party AI services will always be available
- Results will be suitable for a particular purpose
- Information provided by the App will always be complete or current
You use the App and its AI-generated content at your own discretion and risk.
16. Limitation of Liability
To the maximum extent permitted by applicable law, MK APPS PVT LTD and its owners, employees, affiliates, licensors, and service providers will not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from or related to:
- Your use or inability to use the App
- AI-generated content
- Errors or inaccuracies in AI-generated results
- Content submitted by users
- Third-party AI services
- Loss of locally stored application data
- Service interruptions
- Unauthorized access or security incidents beyond our reasonable control
Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited under applicable law.
17. User-Generated and AI-Generated Content
The App may generate or process content on behalf of users.
We do not endorse user-generated or AI-generated content merely because it is available through the App.
Users are responsible for reviewing and using generated content appropriately.
We may take reasonable steps to restrict content or activity that violates these Terms, applicable laws, or our safety requirements.
18. Safety and Misuse
The App must not be used for activities that could cause harm to individuals, organizations, or the public.
Users must not use the App to facilitate illegal activities, fraud, abuse, violence, exploitation, or other harmful conduct.
Users are responsible for ensuring that their use of the App complies with applicable laws and regulations.
We may cooperate with lawful requests from appropriate authorities where required by applicable law.
19. Termination
We may suspend or terminate your access to the App or particular features if:
- You violate these Terms
- You use the App for prohibited activities
- You attempt to circumvent technical or safety restrictions

Upon termination, provisions that by their nature should continue to apply will remain in effect.

When we update these Terms, we may change the Effective Date and, where appropriate, provide additional notice within the App.
Your continued use of the App after updated Terms become effective constitutes acceptance of the updated Terms, except where applicable law requires additional consent.
22. Governing Law
These Terms shall be governed by and construed in accordance with the applicable laws of Punjab, India, without regard to conflict-of-law principles.
Any disputes shall be subject to the applicable jurisdiction of the courts having jurisdiction in Punjab, India, to the extent permitted by applicable law.
